Terms and Conditions – SuperVista

1. Scope and Operator

These Terms and Conditions apply to the use of the platforms of the SuperVista Group ("Services") and to all orders placed via the platforms.

The SuperVista Group includes the following services:

• Pub&Go – digital ordering and payment platform for hospitality
• Brillen.de – online optician (Germany)
• Brillen.pl – online optician (Poland)
• Gafas.es – online optician (Spain)

Operator of the Services:

All food service venues accessible via the Pub&Go platform are operated by us directly. Pub&Go is not an intermediary but your direct contractual partner for food, beverages and related service.

1.4 The applicable company for the respective contractual relationship is the entity of the country in which the venue is located.

2. Formation of Contract

• 2.1 The contract for the use of our Service is formed upon first use of the platform.
• 2.2 The purchase contract for food and beverages is formed directly between you and the respective Pub&Go entity (UG or SLU).
• 2.3 By submitting an order you make a binding offer to purchase, which we accept by sending an order confirmation.

3. Description of Services

• 3.1 The SuperVista Group provides digital platforms through which product and service offerings can be viewed, orders placed, payments processed and order confirmations sent.
• 3.2 As we operate the food service venues ourselves, we are responsible for the quality, freshness and safety of food and beverages in accordance with applicable food law regulations.
• 3.3 Waiting times may vary depending on the level of activity. Times shown are estimates and are not binding.

4. Prices and Payment

• 4.1 All prices shown are final prices including statutory VAT.
• 4.2 Payment is processed via secure payment service providers (Stripe Payments Europe Ltd.).
• 4.3 Upon completion of payment, the purchase price is due immediately.
• 4.4 Tips are voluntary and remain 100% with the respective venue.

5. Right of Withdrawal

• 5.1 Under § 312g para. 2 no. 1 of the German Civil Code (BGB), no right of withdrawal exists for contracts for the delivery of goods that are liable to deteriorate rapidly or whose expiry date would quickly be exceeded. This applies to all food and beverages ordered via Pub&Go.
• 5.2 For orders placed in Spain, Art. 103(d) of Real Decreto Legislativo 1/2007 (LGDCU) applies accordingly, which excludes the right of withdrawal for goods that are liable to deteriorate rapidly.
• 5.3 For other products and services, the statutory withdrawal provisions apply.
• 5.4 Cancellations are only possible as long as preparation has not yet begun. Please contact the relevant venue directly or email support@pubandgo.de without delay.

6. Liability

• 6.1 The SuperVista Group is fully liable for damages arising from injury to life, limb or health, as well as in cases of intent and gross negligence.
• 6.2 As operator of the food service venues, we are liable for the quality and safety of food and beverages in accordance with applicable food law (in Germany: LFGB, EU Regulation 178/2002; in Spain: Real Decreto 1086/2020, EU Regulation 178/2002).
• 6.3 In cases of slightly negligent breach of material contractual obligations, liability is limited to foreseeable, typically occurring damage.
• 6.4 Liability for indirect damages, consequential damages or loss of profit is excluded to the extent permitted by law.

7. Warranty and Complaints

• 7.1 As the direct operator, we are your point of contact for complaints regarding food and beverages.
• 7.2 Please address any complaints to: support@pubandgo.de
• 7.3 For technical issues with the platform, please also contact the support addresses listed.

8. Data Protection

• 8.1 The processing of personal data is carried out in accordance with our Privacy Policy.
• 8.2 The provisions of the GDPR (Regulation (EU) 2016/679) apply. In Spain, Ley Orgánica 3/2018 (LOPDGDD) and Ley 34/2002 (LSSI) for electronic communications additionally apply.

9. Terms of Use

• 9.1 Use of the platforms is only permitted for persons of legal age (18 years and over).
• 9.2 When ordering alcoholic beverages, you confirm that you have reached the legally required minimum age.
• 9.3 Abusive use of the platforms (e.g. fictitious orders, disruption of operations) is prohibited.
• 9.4 To comply with youth protection laws, we collect your date of birth. Age verification is mandatory when purchasing alcoholic beverages via Pub&Go. Persons under the legal minimum age are prohibited from purchasing alcoholic beverages.
• 9.5 You can delete your SuperVista account at any time – either directly via the account settings in the app or by sending an email to privacy@pubandgo.de. After deletion, your data will be removed unless statutory retention obligations apply.

10. Intellectual Property

• 10.1 All content on the platform (texts, images, logos, software) is protected by copyright.
• 10.2 Use is only permitted within the scope of its intended purpose.

11. Changes to the Terms

• 11.1 We reserve the right to amend these Terms at any time.
• 11.2 Amendments will be announced on the platform and, if appropriate, by email.
• 11.3 Continued use following notification constitutes acceptance of the amended terms.

12. Applicable Law and Jurisdiction

• 12.1 Contracts with Pub&Go UG are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
• 12.2 Contracts with Pub & Go Spain, S.L.U. are governed by Spanish law.
• 12.3 Mandatory consumer protection provisions of the customer's country of residence remain unaffected.
• 12.4 The place of jurisdiction for merchants is Königs Wusterhausen (Germany) and Madrid (Spain) respectively.

13. Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
